TERMS OF USE OF HSL S.r.l.’s WEBSITE

Access to the site https://hsl-italia.com/ (hereafter known as the Site) owned by HSL S.r.l. (hereafter known for its role as the Data Controller), the query and any use (including download, etc.) of its contents is subject to the following terms of use (hereafter the Terms). Whoever accesses the Site (from now on referred to as the User/s) accepts the Terms and expresses its consent to be legally bound to comply with the Terms themselves.

The Data Controller reserves the right to modify the Terms at its discretion and at any time, recommending to regularly check the current text, given that access to the Site shall in any case lead to the acceptance of any changes made.

In the event of infringement of any provision of the Terms in force at the time of use, the authorisation to use the Site must be considered automatically revoked and all material downloaded or printed by Users in breach of these Terms of Use must be immediately destroyed by Users themselves.

Any conduct/action consisting of the breach of the prohibitions contained in the Terms shall be brought to the attention of the relevant authorities and prosecuted in all the relevant civil and criminal proceedings pursuant to current international laws and conventions.

The Data Controller has the right to modify, at any time and at its discretion, any contents and the functional and operational methods of the Site, without prior notice and therefore without prior or subsequent notification.

The contents of this Site are for information purposes only and do not represent in any way an offer to sell products/services.

The Data Controller’s products/services described in the Website are merely representative. The Website, however, does not necessarily contain all the Data Controller’s products/services, nor are all the products/services described available or shall necessarily be available. The Data Controller reserves the right to change without notice the features of the products/services described. The Data Controller’s newsletter, if the service is provided, (as well as information on the site) are free information tools available to all those who are interested in receiving them and cannot be deemed suitable and / or adapted to specific cases in absence of a prior assessment of specific cases (privacy@hsl-italia.com).

The processing of data within the services, and its transfer, including its contents, may involve the use of other networks and systems and the Data Controller’s need to make changes to the services in order to conform them or adapt them to the technical specifications, to the standard of connection of own networks or to the equipment and connection programmes.

In this regard, the User acknowledges that the Data Controller may change the contents and general rules for the use of the services at any time and at its sole discretion, without any obligation for compensation and / or assuming any liability whatsoever.

The Data Controller shall ensure that the information contained in the Website meets the requirements of reliability, correctness, accuracy, completeness and is up-to-date. The Data Controller does not guarantee the accuracy and completeness of any contents published on the Website or that the information is free from errors or that any faults shall be corrected.

In any case, the Data Controller shall not assume and therefore shall be held harmless of any liability for any errors, inaccuracies, misstatements and omissions found in published contents, derived from material errors or printing typos, entering of data, formatting or scanning. The same considerations also apply to the contents of the Website, produced by third-party companies on which the Data Controller relies.

The Data Controller and the Technical Facilities authorised by the latter, protect the computer system against the risk of intrusion and the action of programmes aimed at damaging or interrupting the operation, by adopting appropriate electronic tools and anti-virus systems. The Data Controller is also not liable for any damages deriving from inaccessibility to the services on the Site, failure to use the Website, delay in updating the relevant information, or for damages resulting from interruptions, suspensions, delays or anomalies in the connection to the Site dependent on the supply of electricity or telephone service or the malfunction of the Internet or any other cause beyond the Data Controller’s control.

By accessing the Site, Users undertake to indemnify, holding the Data Controller harmless from any third party claims, damage, loss, cost, expense (including related legal and judicial expenses reasonably incurred) arising from the use of the Site or in connection with it.

Site Security (unauthorised access and use of the Site)

Users of the Site are authorised to consult only the documents contained in the Site menus. Any unauthorised attempt to overcome or circumvent the Site’s protection features, in order to use operating systems that operate or are connected to the Site for uses other than those for which they are intended and to prevent their use by authorised Users is prohibited; as well as to access, obtain, destroy, modify, damage information contained therein or interfere with such systems.

Intellectual property rights

Possible contributions/messages and credentials of Users

Users acknowledge to be the creators and solely responsible for any and all data (information, message, text, software, data, sound, music, photography, graphics, video and other material, etc.) that they send, disclose, exchange or make available in any form on the Site, undertaking to indemnify and hold the Data Controller harmless from any claims and/or claims of third parties relating to and/or connected to their Contributions.

User undertake not to forward Contributions containing specific categories of data (sensitive/judicial), as well as to enter illegal materials or to publish photos and/or images of minors, forms and/or contents of a pedo-pornographic, pornographic, obscene, blasphemous nature or which are defamatory, offensive, contrary to public order or morality, in breach of any applicable law, which promote or lead to illegal activities or that contain viruses or other programmes which may damage other people’s computer systems.

The Data Controller hereby states that it does not under any circumstances perform a prior check on Users’ Contributions, and is not required to monitor the lawfulness, truthfulness, accuracy, non-misleading and non-offensive nature of Contributions. In any case, the Data Controller reserves the right to refuse and / or delete at its discretion Contributions that it may deem as not suitable for publication, transfer, disclosure, exchange or provision via the Site’s Services. The Data Controller is exempt from any liability for damages, claims or losses, whether direct or indirect, arising from Users or third parties from the transfer, disclosure, exchange or provision of Contributions provided by Users through the Service.

Applicable law

The Site is managed by the Data Controller and the relevant services are aimed only at Users resident in Italy. The Data Controller assumes no liability for the fact that the materials on the Site are used outside Italy. The connection to the Site from countries other than Italy is carried out under the sole responsibility of Users, who shall assume any liability arising from the application of obligations other than those provided by Italian law (which they are required to comply with all under all circumstances).

Any dispute related to the application of the Terms shall be subject to Italian jurisdiction and to the exclusive jurisdiction of the Court of Trento.

Users are reminded to read the Privacy Policy (Information disclosure) published on the Website in order to understand how the Website collects and uses the Users’ personal data and for what purpose – which also applies in the event where Users access the site, and use the relevant services.
